All you need to know about family reunification

The family reunification is a right exposed in the article 8 of the European Convention on human rights. In Luxembourg (and in many other European countries) the family reunification for the family members with third country national nationality is different according to the status of the principal “migrant”. The rights of the family members are attached to the principal “migrant”.

Family members allowed joining the principal “migrant” if the principal “migrant” is a citizen of the European Union:

  • Spouse or register partner
  • Partner of free union (1 year of previous cohabitation and/ or child(ren) with common parental authority)
  • Child(ren) of the EU citizen or of his/her spouse aged less than 21 years old or dependent
  • Dependent direct ascendant of the EU citizen or of his/her spouse
  • All the other dependent members of the family (in the country of origin) or ill person which were dependent of the EU citizen in the country of origin.

Family members allowed joining the principal “migrant” if the principal “migrant” is a third country national:

  • Spouse or register partner over 18 years old
  • Child(ren) of the third country national “migrant” or of his/her spouse aged less than 18 years old or dependent

The Minister can also allowed (but it is not a right as for the both first categories)

  • Dependent direct ascendant of the third country national “migrant” or of his/her spouse without any support in the country of origin
  • Ill, Single major child(ren) of the third country national “migrant” or of his/her spouse

If the principal “migrant” is from a third country, the delay to be allowed to apply for the family reunification will depend of his own status; for example if the principal “migrant” received a Residence permit “salaried employee” the delay is 1 year. In the opposite for the high skilled worker with a Residence permit “European blue card” the family is allowed to come directly.
